Introduction

Welcome to Markswipe. These Terms of Service ("Terms") govern your use of our website at https://markswipe.com/ and our video marks removal service (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.

Definitions

• "We," "us," "our": Refers to Markswipe
• "You," "your," "user": Refers to the individual or entity using our Services
• "Content": Includes the videos you upload, the cleaned videos we produce from them, and any other material submitted or generated through our Services
• "Marks": Watermarks, subtitles, captions, text overlays, logos and other objects embedded in a video
• "Account": Your registered account on our platform

Acceptance of Terms

By creating an account, accessing our website, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You also represent that you are of legal age to form a binding contract.

Service Description

Markswipe provides an AI video processing service that removes marks from videos. Our Services include:

• Detecting and erasing watermarks, subtitles, text, logos and other marks from videos you upload, either automatically or in areas you select manually (up to two boxes per video)
• A free, watermarked, reduced-resolution (720p) preview of the cleaned video, for videos up to 60 seconds long
• Unlocking a clean download at the processed source resolution, without the Markswipe preview watermark, in exchange for credits
• Temporary storage of your uploads and results, as described in our Privacy Policy
• Additional features as we may introduce from time to time

We deliver digital files only. We do not encode, stream or distribute video on your behalf, and nothing in these Terms should be read as a promise to do so.

Third-party processing

Cleaned videos are produced by a third-party AI video processing service (currently Alibaba Cloud's Intelligent Media Services, IMS). This has consequences you should understand before using the Services:

• Your video is transmitted to this third-party provider so that it can be processed, as described in our Privacy Policy
• Output is probabilistic. The same video can produce different results on different attempts
• We do not guarantee that every mark will be removed cleanly, or that the cleaned video will be free of visual artefacts
• Results depend heavily on the quality of the video you upload and the marks you ask us to remove

This is why we let you generate a free watermarked preview before you spend anything. You are expected to review the preview before unlocking a paid download.

Account Registration and Security

Account Creation

• You must provide accurate, current, and complete information during registration
• You must maintain and promptly update your account information
• You are responsible for maintaining the confidentiality of your account credentials
• You must immediately notify us of any unauthorized access to your account

Account Eligibility

• You must be at least 13 years of age to use our Services
• If you are under 18, you must have parental or guardian consent
• You must not create an account if we have previously banned or suspended you

Account Security

• You are solely responsible for all activities that occur under your account
• We are not liable for any loss or damage arising from your failure to maintain account security
• You should use the security controls offered by your identity provider, including two-step verification where available

Use of Services

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Upload videos that are illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Create deepfakes or misleading content intended to deceive or harm others
• Infringe on intellectual property rights of others
• Use our Services to generate spam, phishing content, or malware
• Attempt to reverse engineer, decompile, or extract our AI models
• Circumvent any access or usage limitations we have implemented
• Use automated tools to access our Services without authorization
• Interfere with or disrupt our Services or servers
• Impersonate any person or entity

Video rights and copyright

By uploading a video, you represent and warrant that you own the video, or have the rights and permissions needed to process it and to have it processed by third parties, including the right to remove marks from it.

Please understand that removing a watermark, subtitle or logo does not change who owns the underlying video. If you do not have the right to use or redistribute the underlying video, removing its marks does not give you that right. You are solely responsible for ensuring that your use of any cleaned video complies with the rights of its owners and applicable law. We do not investigate, endorse or guarantee the ownership of any video you upload.

Service Availability

Our Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that our Services will be:

• Uninterrupted or error-free
• Secure or free from viruses or other harmful components
• Available at all times or in all locations
• Accurate or complete in their output

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with or without notice.

Intellectual Property Rights

Our Intellectual Property

Our website, Services, and all original content, features, and functionality are owned by Markswipe and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our Services for their intended purpose. This license does not include:

• Resale or commercial use of our Services or their content
• Collection and use of product listings, descriptions, or prices
• Making derivative uses of our Services or their content
• Downloading or copying content for any party other than yourself
• Use of data mining, robots, or similar data gathering tools

User Content

Content You Submit

You retain all rights to the videos you upload. By uploading a video, you grant us a worldwide, non-exclusive, royalty-free license, limited to the purpose of operating the Services, to:

• Store your video so that you can generate cleaned versions and retrieve them later
• Transmit your video to the third-party AI video processing providers we use, so that it can be cleaned
• Create derivative files (the cleaned video, its watermarked preview, and its processed source-resolution version) from it

This license exists only so that we can run the service for you. It ends when you delete your account or ask us to remove the content, except for copies retained in routine backups for a limited period.

We use your videos and cleaned results to provide the service you requested and share them with the providers needed to fulfil that request. Third-party processing is governed by those providers' own terms and privacy commitments. Do not upload content that you do not have the right to process.

We will not publish your videos or results in marketing, on our website, or on social media unless you give us explicit permission to do so.

Content You Generate

For videos produced through our Services:

• You own the cleaned video produced from your own video, subject to the rights of the owners of the underlying content (see "Video rights and copyright" above)
• Generated content must comply with our Acceptable Use Policy
• We reserve the right to remove content that violates these Terms

Content Responsibility

• You are solely responsible for your content and the consequences of posting or publishing it
• You represent and warrant that you own or have the necessary rights to all content you submit
• You will not submit content that infringes on third-party intellectual property rights
• We do not endorse any user content or opinions expressed through our Services

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Technical Restrictions

• Accessing or attempting to access our Services by any means other than through our provided interfaces
• Attempting to probe, scan, or test the vulnerability of our systems or networks
• Breaching or circumventing any security or authentication measures
• Reverse engineering, decompiling, or disassembling any part of our Services
• Using automated systems (bots, scrapers) without our written permission

Harmful Content

• Creating content that promotes violence, terrorism, or illegal activities
• Generating content that exploits or harms children
• Producing content that violates privacy rights or contains personal information without consent
• Creating misleading deepfakes or manipulated media without proper disclosure

Abuse of Services

• Using our Services in a manner that could damage, disable, or impair our infrastructure
• Engaging in any activity that interferes with other users' access to our Services
• Creating multiple accounts to bypass usage limits or restrictions
• Reselling or redistributing our Services without authorization

Payment and Credits

No subscription

Markswipe does not sell subscriptions. We sell one-off packs of credits. Buying a pack is a single purchase: nothing recurs, nothing renews automatically, and there is nothing to cancel.

Pricing

• Current pricing is shown on our pricing page and at checkout
• The price shown at checkout is the price you pay
• We may change prices at any time, but a change never affects a purchase you have already made

Credits

• Credits are spent to unlock a clean download at the processed source resolution without the Markswipe preview watermark
• One credit covers one second of video. Unlocking a 60-second video costs 60 credits
• Generating a free watermarked preview does not consume credits
• Credits are only consumed when you unlock a download of a successfully processed video. If processing fails, you are not charged for it
• Credits purchased in the current pack expire 12 months after purchase. The expiry date is shown on your credits page
• Credits have no cash value, are not transferable between accounts, and cannot be redeemed for money except where required by law

Billing

• Payment is due immediately upon purchase
• We use Stripe as our payment processor. We do not receive or store your full card details
• You must provide current, complete, and accurate billing information

Refunds

Refunds are governed by our Refund Policy. Requests involving unused credits, partial use, failed processing, or completed downloads are reviewed manually using payment and usage evidence. A request or dispute does not automatically reclaim credits, create a negative balance, or revoke a file already downloaded. Mandatory legal rights take priority over our ordinary policy.

Fair use

Free processing is limited: videos up to 60 seconds long, with a per-account cap on the number of free jobs (currently 2 per day and 6 total per account). We may impose limits on the number of free jobs per account or device, and may restrict or suspend accounts that appear to be automating or abusing the free tier. This is necessary because every processing job costs us money to produce.

Termination

Termination by You

• You may terminate your account at any time through your account settings
• Termination does not relieve you of any obligations to pay outstanding fees
• Upon termination, your right to access and use our Services will immediately cease

Termination by Us

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of our Acceptable Use Policy
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Request by law enforcement or government agencies
• Discontinuation of our Services

Effect of Termination

Upon termination:

• Your right to use our Services will immediately cease
• We may delete your account and all associated content
• You remain liable for all charges incurred prior to termination
• Provisions of these Terms that should survive termination will remain in effect

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Services will meet your requirements or be available, timely, secure, or error-free
• Warranties regarding the quality, accuracy, or reliability of any content obtained through the Services

Limitation of Damages

IN NO EVENT SHALL MARKSWIPE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use our Services
• Unauthorized access to or alteration of your content
• Statements or conduct of any third party on our Services
• Any other matter relating to our Services

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Geographic Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Markswipe, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of our Services
• Your content or any content you submit
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

Dispute Resolution

Governing Law

These Terms are governed by the laws that apply to the operator of Markswipe and to you as a user. Nothing in these Terms removes mandatory consumer protections or other rights that cannot lawfully be waived in your place of residence.

Informal Resolution

Before filing a claim, you agree to contact us at support@markswipe.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations within 30 days.

If we cannot resolve a dispute informally, either party may use the courts, regulators, or alternative dispute-resolution bodies that have jurisdiction under applicable law.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by:

• Posting the updated Terms on our website
• Updating the "Last updated" date at the top of this page
• Sending you an email notification (for significant changes)

Your continued use of our Services after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using our Services.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Markswipe regarding our Services.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms or our rights hereunder without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
